The FlySmart Terms of Service (“Agreement”)

Please read these Terms of Service completely using https://flysmarttraining.ca which is owned and operated by FlySmart. This Agreement documents the legally binding terms and conditions attached to the use of the Site at https://flysmarttraining.ca.

By using or accessing the Site in any way, viewing or browsing the Site, or adding your own content to the Site, you are agreeing to be bound by these Terms of Service.

ADVANCED/BASIC COURSE POLICIES

Refund Policy

We are excited to host you in our course, but we know sometimes life happens. Payment must be made upon registration. 

  • Full refunds will be issued for cancellations made at least 7 days before the scheduled course date.

  • Cancellations made within 4 days of the scheduled date will be eligible for a 50% refund. 

  • No refunds will be issued for cancellations made within 3 days of the scheduled date. 

  • Refunds may be issued under select circumstances if appropriate notice is given.

Cancellation Policy

Participants must notify us to cancel their registration. If a participant needs to cancel due to an emergency, they may be eligible for a full refund or rescheduling, subject to proof and company discretion. If a participant does not inform us of their cancellation or absence from the course, they will be considered a no-show. 

No-show Policy

Participants who fail to attend a course without any prior notice will be considered a no-show. No refunds will be issued for no-shows. The course must be re-purchased in full if/when the participant rebooks the course.  

Rebooking Policy

Up to 7 days before the course start date, participants can change course dates at no cost. Rescheduling course dates less than 7 days before the original course start date will be reviewed on a case-by-case basis, and charges may be incurred. After 3 consecutive reschedules, the participant will be asked to re-purchase the course at full price. If a participant misses a course and does not give us any notice, the course must be re-paid in full when rescheduling. 


FLIGHT REVIEWS

Eligibility

Participants must ensure that they are eligible to do their flight review as outlined by Transport Canada. 

  • Are a Canadian citizen or a permanent resident

  • Be 18 years of age or older

  • Have passed the Transport Canada Advanced Exam

What happens if you fail?

If a participant fails a flight review with us, they will be given a 25% discount off the full price of a flight review ($299) to rebook. Any additional travel fees or added costs associated with performing the flight review must be re-paid in full. 

Weather Related Cancellations

If the flight review is cancelled due to inclement weather, the participant will be offered the option to reschedule at no additional cost. The decision to cancel due to weather will be made by the instructor on the day of the flight review based on safety considerations and the limitations of the drone. 

Travel Fee Policy

For flight reviews that require travel and/or accommodation arrangements, additional fees will be communicated to the participant prior to booking. The travel costs must be paid in full at the time of booking and are non-refundable. 

Rescheduling/Cancelling Flight Reviews

Participants must notify us at least 48 hours before the scheduled flight review to cancel or reschedule without incurring additional charges. 


INSTRUCTOR CANCELLATIONS

Just as life happens for our students, it also happens for our instructors! If a FlySmart instructor or flight reviewer needs to cancel for any reason, the participant(s) will be notified with as much notice as possible, with the option to reschedule at no additional cost. If there is no option for rescheduling in the foreseeable future, the participant may be granted a refund for their course or flight review at our discretion. 


FLYSMART WARRANTY

Need Extra Support?

If you’ve taken a course with FlySmart and need some extra help passing the exam, our warranty allows participants to take the course again anytime within a year, for free.

FlySmart Graduate Discount

Participants who graduate from FlySmart’s Advanced Course are eligible for a 25% discount on their flight reviews when scheduled through us. 


INTELLECTUAL PROPERTY

The Site and all of its original content are the sole property of FlySmart and are, as such, fully protected by the appropriate international copyright and other intellectual property rights laws. 

Course Materials

The content provided in our courses, including but not limited to, training materials, documents, video, images, and any other information that is not already publicly available, is the property of FlySmart Training and is protected by intellectual property laws. The materials are provided to participants for their personal education use only, to assist in their learning and exam preparation. We permit participants to download and retain copies of the course materials for their personal use. However, participants are strictly prohibited from sharing, distributing, selling, or otherwise making these materials available to any third party, whether in their original form or any modified version. This includes but is not limited to, sharing the materials with individuals who are not enrolled in the course, uploading them to any file-sharing or social media platforms, or using them for commercial purposes. Furthermore, participants are not allowed to modify the course materials or create derivative works based on them without our prior written consent. Any unauthorized modifications or derivative works are considered a violation of our intellectual property rights.

If a participant becomes aware of any unauthorized use, modification, or distribution of our course materials, the participant should report it to us immediately at info@flysmarttraining.ca. 

By accessing and using our course materials, participants acknowledge and agree that any unauthorized use of the materials may constitute a violation of our intellectual property rights as well as applicable laws. We reserve the right to take appropriate legal action to enforce our rights, including seeking injunctive relief and damages.

LINKS TO OTHER SITES

Our Site contains links to other websites and online resources that are not owned or controlled by FlySmart.

FlySmart has no control over, and therefore cannot assume responsibility for, the content or general practices of any of these third-party sites and/or services. Therefore, we strongly advise you to read the entire terms and conditions and privacy policy of any site that you visit as a result of following a link that is posted on our site.

CHANGES TO THIS AGREEMENT

FlySmart reserves the right to modify these Terms of Service at any time. We do so by posting and drawing attention to the updated terms on the Site. Your decision to continue to visit and make use of the Site after such changes have been made constitutes your formal acceptance of the new Terms of Service.

Therefore, we ask that you check and review this Agreement for such changes on an occasional basis. Should you not agree to any provision of this Agreement or any changes we make to this Agreement, we ask and advise that you do not use or continue to access the FlySmart site immediately.

PRIVACY

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from https://flysmarttraining.ca (the “Site”).

Personal Information We Collect

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

– “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies and how to disable cookies, visit http://www.allaboutcookies.org.

– “Log files” track actions occurring on the Site and collect data, including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

– “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.

Additionally, when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as “Order Information.”

When we refer to “Personal Information” in this Privacy Policy, we are referring to both Device Information and Order Information.

Data Retention

When you place an order through the Site, we will keep your Order Information for our records unless and until you ask us to delete it.

Changes

We may update this privacy policy from time to time to reflect changes to our practices or for other operational, legal, or regulatory reasons.
